It is upto a competent court to make a conviction based on corruption allegations. The task of journalists is to highlight possible corruption so that investigations can proceed until the process of the law takes over from there. Danuna Tillakaratne started a business in USA in 2001. This is his first company. Its name is Tidal Trading. It stated with exporting used computers, monitors, laptops to Sri Lanka. Its address is the same as Danuna’s other businesses including the notorious HiCorp. It’s 17545 Gold Dr, Oklahoma City, Oklahoma, United States. Interestingly he has stated the name of the legal representative as “Dan” and contact person as “Dan Til”. It is not rocket science to see that it is none other than Danuna Tillakaratne!

In describing their business, they had this to say, “We Export used computers, monitors, laptops to Sri Lanka. We will be interested in purchasing used computers from USA, in quantities of 40Ft containers. Used computers should be tested and working. We have a company branch located in USA. Please send us your company details, information and price quotation for bulk orders”.

However, in 2005 Tidal Trading changes its business from a low profit used computer business to a weapons trading company. This is what they had to say then. “We are from a company that supplies military equipment to the Military (Army, Navy, Air force) in Sri Lanka. IWe are in the process of fining new military suppliers from Russia/china/USA/Ukraine/etc.”

Dayasiri collapse on TV debate on Fonseka’s Corruptions

UNP parliamentarian Dayasiri Jayasekara yesterday (Jan 8) almost collapsed and begged for a postponement at the TV debate organized on massive corruption charges brought against presidential candidate Sarath Fonseka. The TV interview was organized by the privately owned TV channel Swarnawahini.

Representing the government, Minister Rajitha Senarathne and Wimal Weerawansa MP came for the interview. UNP representatives agreed to come for the interview were provincial council member Sujeewa Senasinha and MP Dayasiri Jayasekara. However, only Dayasiri Jayasekara was present but soon collapsed before the well prepared government whips.

The debate was first challenged by leader of National Freedom Front, Wimal Weerawansa during a recent media briefing .He confirmed of having substantial evidence against Fonseka and challenged the former military View the Video clipchief now turned politician to defend himself at public debate. Fonseka was quick to refuse the challenge and also threatened to avenge MP Weerawansa once he is elected president. Later, MP Jayasekara was seen on the TV saying that he can defend Fonseka’s integrity at any debate.

Meanwhile, well informed sources confirm that corruption charges against Fonseka are now well substantiated. According to the sources, Fonseka had carried out massive frauds in purchasing arms during his tenure as the Army Chief. While performing as the chairman of the army tender boards, Fonseka had carried out arms deals worth of billions of rupees with a US based company Hicrop , owned b his son in law Danuna Thilakrathne .

The police criminal investigation department (CID) recently arrested one of the directors of Hicrop, Mr. Wellington Tentron . According to informed sources , the suspect has divulged vital information about the fraudulent deals carried out by the company at the behest of then Army Chief, Sarath Fonseka.

Care-taken candidate S. Fonseka had to postpone his scheduled visit to Batticaloa Tuesday (Jan 6) as he was informed of a very poor gathering not exceeding a dozen for the propaganda election rally. However, Fonseka in utter dismay have held a pocket meeting only with the presence of a few at Ampara.

Meanwhile, the pro-LTTE propaganda site Tamilnet had spun the story funneling sympathy on Fonseka, while alleging the GoSL for inadequate security. According to informed sources, Tamilnet has taken responsibility of international propaganda-tapping the diasporas financial resources for Fonseka’s election campaign.

‘Scars of Unnatural Lust’: Fonseka shadows Yakandawala’s heroics

If it was not for the heroics of Corporal Chaminda Yakandawala of the Sri Lankan Army Military Police corps (MP), Mr. Fonseka would have had to bear more scars than he is left to cherish today.

Having to blame himself and non-other for an almost ‘suicidal’ attempt that started from a just bed-side lingering to a longtime mutual relationship with an LTTE ploy (Anoja Kugantthirasa), Mr. Fonseka seems to have forgotten to pay homage to the very brave individual who sacrificed himself obliging to the military’s highest standards for the formers sins.

Now he(Fonseka) through his media mafia in an embarrassing effort is making fullest to gain popular sympathy through image flashes of his scarred body and no mention of the true hero Yakandawala. Following suite like the bandit-queen Chandrika Kumaranathunge who merely escaped death and forgotten those dead in her personal security guard, Fonseka is due to pay even a courtesy visit to the soldier’s house.

Yakandawala in a daring dash at the LTTE woman suicide bomber ( Fonseka’s bed partner for two months) saved Fonseka and minimizing the loss of lives at the Army headquarters on 25th April, 2006. Ironically, it was the first time the LTTE had been successful in exploding a suicide cadre in a military HQ in Sri Lanka. Yakandawala on motor cycle raised his left foot and dealt a tremendous kick on the tiger woman thrusting her away from the vehicle while the bomb concealed under her dress exploded with a thunderous noise killing nine persons including Chaminda Yakandawala.

The life of Mr.Fonseka was saved by hair's breadth. If not for this timely kick by Corporal Yakandawala, the explosion would have blasted the Army Commander's vehicle into a mass of debris charring all those who were in it.

Later, investigations made by the military intelligence transpired that the responsible to bare fault on the security breach the Army Commander himself and thus the findings were sent into a dark cellar, if not which could have rattled the entire Army. In fear of a possible revelation into the true story, Fonseka through his sleuths spinned and twisted the report directing accusation towards Corporal Yakandawala. He was posthumously denied of any award or medal for his heroics while his wife was denied any compensation from the Army.

Yakandawala was portrayed as a traitor and news reports were dispersed by Fonseka’s media mafia on alleged sexual relationship between the suicide cadre and Yakandawala.

Meanwhile, Secretary Defence in reply to a redress made by Mrs. Yakandawala immediately restored Yakandawala with gallantry and followed suit to give total military courtesy and compensation for the widow, despite constant opposition from Fonseka.

Naveen pledges fullest support to President

Minister of Investment Promotion Naveen Dissanayake has emphasized that he will never ditch the Government. Speaking at a media briefing, he noted that not only his support but also his mother’s support is for President Mahinda Rajapaksa.

He told the media that he had been engaged in politics for 20 years. He gave forward only one condition to the President. The President was told that he would be with the President, if he continues to take initiatives against the LTTE outfit, which is suspected of killing his father. The President clearly mentioned that he would continue his actions against the LTTE whatever pressure he had to confront.


Dissanayake said that it was on that condition that he was supporting the President. He wanted to be with the leader who had ended the war enthroning peace in the country. He pledged continued support to the President.

Number of IDPs reduce considerably

There are only 79,965 IDPs remaining in eight welfare centers in Vavuniya while 1,349 IDPs are in Jaffna, Minister for Disaster Management and Human Rights, Mahinda Samarasinghe said yesterday (07) at a press briefing.

In addition, a total of 19,683 have used the freedom of movement granted by the government begining December, while 2705 are yet to return to welfare centers on the days given by them, he noted.

As of yesterday (07), a total of 169, 891 IDPs have been released and resettled in the North out of over 270,000 IDPs displaced, he added.

You shared the victory and responsibility of winning the 30-year terrorist war in Sri Lanka along with three other service commanders, the victorious President who provided political stability and leadership determined to destroy LTTE terror in order to bring economic prosperity to people and a Strategic & brilliant Defence Minister. Among those deserve partial credibility for this victory are the SL Police, STF and its intelligence operatives for capturing LTTE suicide-bombers to save innocent civilians from being cold-bloodedly blasted into bits.

After all this, you have become a self-promoting traitor to assert that Minister of Defence had ordered shooting of surrendering LTTE leaders. YOU ARE A TRAITOR! YOU HAVE PROVEN THIS on the newspaper partial to your campaign, the Sunday Leader a few weeks ago, causing much controversy worldwide. If shooting LTTE leadership and finishing this war off once and for all and destroying the threats posed by world’s most ruthless terrorists was a bad idea, WHAT WERE YOUR ALTERNATE PLANS FOR THOSE COLD-BLOODED LTTE LEADERS AKA MURDERERS WHEN THEY SURRENDERED?????

Who shot the surrendering LTTE Leaders? – The SL Army did.

And Who was the leader (AKA the Commander) of the SL Army? – You, Rtd Gen Sarath Fonseka

If SL Army was responsible for a war crime (according to the International Liberal Politicians), who is ultimately responsible? - The SL Army Commander at the time of incident.

Who should be court marshalled and sent to war crimes tribunal? – Rtd Gen Sarath Fonseka

(when he crossed the political side, the fact that he was responsible for this act cannot be changed or assigned to someone else).

US President Back Obama has categorically stated during his Nobel Peace Prize acceptance speech in Oslo Norway that sometimes, in order to bring lasting peace, WAR is necessary!

Last time when Sri Lanka did this, the US and whole of western-Europe vehemently denounced it and completely went out of their ways to corner Sri Lanka and black-mark it permanently.

When the US and allied troops INVADED other countries and killed hundreds of civilians and terrorists alike, the successive leader of the USA gets the Nobel Peace Prize.

Ironical, categorically hypocritical and contradictory these western policies and strategies are. Tiny island of Sri Lanka with its indomitable but determined people, forces and political leadership

Fights the world’s most ruthless terrorist organization with the most organized crime rings around the world (magnitudes of order larger and deadlier than Al-Qaida) and destroys them once and for all!!

All this with the determination, sacrifices and perseverance of Sri Lanka’s valiant soldiers, sailors, airmen, policemen, special-forces men, field commanders+brigadiers, commanders, minister of Defence and the president of this Island nation with clear political backing to destroy the LTTE menace that has deprived citizens of economic prosperity and caused them to live in fear. The rest of benefits

to the people are subsequent and consequent to the absence of a common enemy (read LTTE). All this was achieved without stealth aircraft, stealth marine craft or sophisticated guided missile technology available to western Nations! Moreover, the US, the UK, Canada and other NATO countries could not avoid any civilian casualties during their invasion of Afghanistan and Iraq, nor could they completely destroy the Al-Qaida nor could they capture the world’s most wanted terrorist, Osama Bin Laden with all that sophisticated military hardware, including satellite tracking and ground imagery.

To top it all, unlike Al-Qaida’s ground-based-only fighting arm, LTTE had 4-dimensional (ground, air, naval and under-water) modes of fighting mechanisms that Sri Lanka effectively destroyed without much help from Western “Friends” who only supported Sri Lanka’s enemy towards the final phases of the war.

It is a crying shame that Sri Lankans are now fighting amongst themselves to claim a sole ownership for victory of winning the war against terror, fought with multiple forces and field/operational/political commanders and leadership. We have braved the world’s most ruthless terrorists. Not a single terror attack occured in Sri Lanka, after LTTE was annihilated. That said, and considering Sri Lanka’s deep history, we shall never override the divide-and-rule mentality inculcated by the dirty British colonial rulers in Sri Lankans’ mindset. We shall always want to claim sole ownership to collective efforts/accomplishments.

Arjuna Ranatunga claimed sole victory of winning the World Cup Championship title, rather than sharing it with the rest of the team, both in media, in public and in person.

You, Rtd Maj Sarath Fonseka, seems to be doing the same.

JVP’s founder-leader Rohana Wijeweera (another traitor of people) and JVP’s most subversive membership were destroyed by UNP regime in the late 80’s (Remember Bheeshanaya during President R. Premadasa’s time?). Today JVP’s current leadership is supporting the very UNP that destroyed them and killed much of its comrades. Mano Ganesan and Ranil Wickramasinghe were outspoken critics of Gen Sarath Fonseka for “Shelling innocent civilians trapped in the No-Fire zones” during ht e final phase of war against LTTE terror. This same shameless Ranil today is desperate down on his knees to get you, Sarath Fonseka to be turned to a traitor and then to run for presidency on his behalf, as no one with an ounce of brains will ever cast a vote for his senility, insanity, record of losing elections and lack of knowledge on common man’s needs. This same Ranil Wickramasinghe tried to destroy our education system in the late-70’s and early 80’s with his White Paper (Dhawala Patrikawa) to make a population of idiots in Sri Lanka during his tenure as minister of Education at the time.

Sri Lankans MUST NOT forget which leaders facilitated you to travel to every part of Sri Lanka as well as work & live in any part of Sri Lanka without fear of getting blown up in to bits by an LTTE bomb or suicide bomber. It was accomplished by a large number of dedicated people of Sri Lanka’s three Military forces, its commanders, the Police and its IGP and the currently existing political leadership. These people sweated years, months, days and hours in the field, sweating, little to eat, no fresh-water to drink, braving thick jungles, without knowing if they will get killed in the moment, braving LTTE bullets, bombs, suicide attacks, mortars, explosives… many, many of our sons, fathers, husbands, brothers, friends dying and severely wounded. These brave sons of Mother Lanka travelled through thick jungle in pouring monsoon rains and dry spells with no drinking water for many miles. They were driven by the courage churned and supplied in plenty by the field-commanders, the commanders, the assertive minister of defence who would not take nothing but victory, and a political president who wanted to provide all the support to finish the war and protect the citizens, including you. When these brave sons were trapped and surrounded by LTTE brigades, our Air Force came to their rescue and took the targets to shoot and dropped bombs to facilitate our valiant ground troops to further forge ahead to take enemy frontlines. Our Naval command destroyed all of LTTE’s arms supplies and sunk over ten ships in deep seas with the military cargo bound for loading mid-sea into LTTE’s submarines. Our brave Navy also deployed FAC’s to destroy LTTE’s sea-tiger fast crafts and their arsenals and suicide sea-tiger brigands. Our Police intelligence nabbed most of the LTTE’s suicide bombers hiding in lodges around Colombo and suburbs awaiting orders to destroy civilian targets. They were all driven by one and only one goal: destroy the Terrorists and bring peace and prosperity to their families and fellow citizens. To make our country a safe place for everyone to live. For Sinhalese, Tamil, Muslim, Burghers, Malays and all others. For all our brothers, sisters, mothers, fathers, sons, daughters and friends, colleagues and neighbours, all of them to live in harmony.

Also, the US and Canadian soldiers have raped, abused and killed innocent young Iraqi girl and her family and hundreds of such innocent civilians including school children during the Iraqi and Afghan wars. Yet you have not cited these to the international community as to why such incidents never received their or human rights activists’ attention? Perhaps if you did point it out, your Green Card status in the USA might have been compromised, right?

Sri Lankans must choose their vote very wisely during this decisive election. You, Rtd. Maj Sarath Fonseka, have gone on record saying you have neither experience nor knowledge of Sri Lanka’s economy, but pointed to novices like Mangala Samaraweera and Ranil Wickramasinghe with same iota of economic knowledge identified as your backups in governance, should you get elected.

Please do not play with the Sri Lankan people’s future anymore. They have suffered more than enough for over 30 years due to LTTE’s terror. Now that they are gone, you need to step back and

ask the puppeteers (aka Ranil et al, and International community) to leave Sri Lankans alone, to show your true concern for your country’s Citizens. If you lose this vote, you will have a Green card to

truly retire in the US and live well with the millions you and your son-in-law commissioned from every bullet that was fired into the LTTE enemy. The rest of Sri Lankan Citizens cannot afford such luxuries.

And remember, Sri Lanka belongs to all Sinhalese, Tamil, Muslim, Burgher, Malay and all else who are citizens there, unlike and contrary to what you have claimed that Sri Lanka is a land only for Sinhalese!!

So, if you make the wrongs right, apologize to the people who deserve, make a statement of your policies and plans for the nation and then drop the UNF desperate-goons altogether and contest on your own, the real people who think you are a true Hero and a candidate capable of running our blessed country WILL vote for you for your actions, promises and credibility.

Last ditch Indian bid to stop war revealed

Had President Mahinda Rajapaksa given in to Indian and joint British-French pressure to halt a combined security forces offensive directed at the LTTE, last April, the terrorist leadership would have survived to fight another day.


Secretary to the President, Lalith Weeratunga revealed that the President had politely explained to both parties that the LTTE could not be given a lifeline again.

Responding to The Island queries, Weeratunga said that Indian delegation comprising Foreign Secretary Shivshankar Menon, Indian National Security Advisor M. K. Narayanan and the then Indian High Commissioner in Colombo Alok Prasad had sought an immediate end to the final assault on the LTTE when they called on the President on April 24. Weeratunga said that the government of India had been concerned about the crisis the Vanni battle could cause, particularly in Tamil Nadu, though the President firmly asserted that Sri Lankan forces could not miss an opportunity to finish off the LTTE.

But the President had assured that everything possible would be done to protect the civilians, the Presidential Secretary said adding that the Sri Lankan leader had gone to the extent of calling an end to the use of heavy weapons on the last LTTE stronghold.

According to him, the President had taken a similar stand when British and French Foreign Secretaries called on him on April 29 as the ground assault was reaching the final stage. The President had said that Sri Lanka could not be forced to call off the offensive at the eleventh hour.

Weeratunga said that any other Sri Lankan leader would have succumbed to international pressure and called off the offensive. Had that happened, the country would not have achieved an outright military victory over the LTTE.

The Army wiped out the LTTE leadership on the banks of the Nanthikadal lagoon on May 19.

Weeratunga said that the President had enjoyed the backing of the people right throughout the military onslaught in the face of resistance from some quarters. Now, the same group was trying to thwart the President’s re-election bid even though the LTTE could not pose a military threat, Weeratunge said.

Recalling the TNA declaration that the LTTE was the sole representative of the Tamil speaking people ahead of the last parliamentary polls in April 2004, Weeratunga said that the TNA before throwing its weight behind Fonseka had held discussions with the ruling coalition. He emphasised that whatever the consequences, the President would not take any decision to jeopardise national security.

JVP given 24 hours to prove Fonseka is clean

The government gave the JVP 24 hours to prove that the common candidate of the Opposition, General (Retd) Sarath Fonseka had never been involved in corrupt arms deals, or accept the fact that the Marxist party was supporting a corrupt candidate.

Power Minister Mahindananda Aluthgamage said that General Fonseka had powers to carry out procurement of arms below Rs. 25 million.

As Chief of Defence staff, he was the Chairman of the tender board on procuring arms and ammunitions. The Minister tabled a document of arms purchases made by General Fonseka and invited JVP group leader Anura Kumara Dissanayake to read it. "We give you 24 hours, read these documents and decide whether the candidate you're supporting is corrupt or not. If you are honest, as you claim to be you must pull out support for Fonseka. If not, you too will be called a bunch of thieves," he said.

He challenged the opposition which, he said was, making allegations to the effect that President Mahinda Rajapaksa and his brothers were involved in corrupt deals, to produce any documentary evidence. If it could do so, the entire Cabinet of ministers would resign forthwith, he said.

UNP Badulla District MP Lakshman Seneviratne said that the Opposition had received information that some Ministers of the government would be tabling some forged documents to sling mud at General Fonseka. "The question we have is why the government failed to bring them up earlier, while Fonseka was in their camp. We, too, have found all the relevant documents. The Hicorp International is a company registered in USA," he said.

"There is a Lankan company by the name Hicorp Private Ltd. These two companies are not connected. Why you did not produce these documents to the CID?"

JVP Kurunegala District MP Bimal Ratnayake reading from a Gazette notification said that the all powers of importing arms and military equipment to Sri Lanka was vested with the Defence Secretary. No other person could import any arms without his knowledge. Sri Lanka has not purchased even a needle from the Hicorp International company, said to be owned by the son-in-law of General Fonseka. If Sri Lanka had imported anything from this company he asked the government to prove it. Another company registered under the Defence Ministry had imported items such as batteries. That company had no connection or involvement of General Fonseka or his son-in-law. The son-in-law of General was in United States for the last 10 years. Son-in-law of General Fonseka, Danuna Tilakaratne, had registered his company in November 2005.

General Fonseka was not the commander of the Army or Mahinda Rajapaksa was not the President of this country. Dhanuna had not even married Fonseka's daughter at that time. The marriage took place in June, 2007.

Engineering Services and Construction Minister Dr. Rajitha Senaratne said that there was clear evidence that Hicorp International had been given a number of contracts to supply equipment to the Sri Lanka Army, when Fonseka was the Commander of the Army. There was evidence that Fonseka had allowed to tender board to accept tenders from the son-in-law’s company after the closing date for tenders and awarded the tender to that company though its bid was higher than others, he said.

The National Procurement Agency, the authority on purchases, had stipulated that so the head of department should not sit on a tender board of he had any interest but Fonseka sat on the board purchasing arms and equipment.

The Minister said that he had documentary evidence of a forged transfer document to change ownership of that company. The signature of a person who was in Sri Lanka had been forged on the transfer document in the USA.

Leader of the National Freedom Front MP Wimal Weerawansa also tabled several bills issued by the Hicorp International which he said would prove that the company had been engaged in supplying military material to the Army.

Later Health Minister Nimal Siripala de Silva tabled four invoices issued by the Hicorp International Company Ltd.

He said that the Hicorp Private Limited Company was a decoy company registered to cover the deals made by the Hicorp International Company.

DUBLIN GOES IN FOR THE KILL : PERMANENT PEOPLES' TRIBUNAL ON SRI LANKA

An elite panel of 11 judges will decide if the President Mahinda Rajapaksa led government and its armed forces were instrumental in carrying out gross violations of human rights and involved in war crimes against innocent civilians in the Northern Province during the run up to its significant yet controversial victory over the ruthless rebel outfit, the Liberation Tigers of Tamil Eelam (LTTE).

With an impressive jury hailing from across the globe, the highly revered Milan based Permanent Peoples’ Tribunal (PPT) will attempt to put an end to months of controversy over the final phase of the war in Sri Lanka, at an international tribunal which will thoroughly investigate allegations that the Government of Sri Lanka and its armed forces committed war crimes and crimes against humanity during its final phase of the war with the LTTE.

The international hearing will be held on January 14 and 15 at the Trinity College, Dublin, with the provisional findings from the tribunal scheduled to be announced at a public meeting on January 16, 2010.

The Tribunal will be co-hosted by the Irish School of Ecumenics, Trinity College Dublin and the School of Law and Government, Dublin City University, Dublin, Ireland. The event is being organised by the Irish Forum for Peace in Sri Lanka (IFPSL).

The government has however shrugged off the Dublin Tribunal terming it as yet another concerted ‘international conspiracy’ against Sri Lanka.

Sunday Leader’s editor defends controversial Fonseka interview

Editor of Sri Lanka’s English weekly, Sunday Leader, who carried the controversial December 13 interview with the commander turned politician Sarath Fonseka, added a new dimension today with her insistence that she had quoted the retired General `perfectly accurately’.

In a detailed report under the title `Her Story’, the Editor of the paper Frederica Jansz said, “The article which, perfectly accurately, quoted the General as saying he had heard that Gotabhaya Rajapaksa had given an illegal order asking Brigadier Shavendra Silva (later promoted General) to not accomodate surrendering LTTE cadres, became more than a news story.

It became a political phenomenon and the allegations, denials, retractions and recriminations that followed are history.

“However it is a history that has come to be grossly distorted. As all the various parties caught in the story’s fallout struggled to save face, what began as a piece of journalism accusing the government of a serious war crime would become, through lies and deception, a coup for the Rajapaksa administration.

“Ultimately the campaign to vilify and distort the article and discredit me has now reached a point where I feel, I must comment and present what I believe to be an accurate version of the events leading to and following its publication”, Ms. Jansz said.

The long explanation by Ms. Jansz came as the former Army Chief did a Volta face and maintained that his comments were wrongly interpreted by the government within 24 hours after the December 13 Sunday Leader hit the stands. The next issue of Sunday Leader carried a clarification from the Presidential contender.

Besides, on December 19, Sri Lankan Defence Secretary Gotabhaya Rajapaksa had demanded rupees one billion in damages from the weekly if it fails to apologise for publishing two allegedly defamatory articles.

In a letter to the Publisher and Editor of the weekly, a lawyer acting on behalf of Mr. Gotabhaya Rajapaksa pointed out that a District Court had already restrained the publication from publishing such news in two earlier cases.

General offers amnesty for LTTE

The former military commander of Sri Lanka standing for presidency has pledged to the main Tamil party to grant a general amnesty for all former militants.
Gen Sarath Fonseka has submitted a proposal named “Immediate Relief Measures for war affected persons,” to the leader of the Tamil National Alliance (TNA).

Over 10,000 former Tamil Tiger cadres are currently detained in different detention centres.

The proposal released to the media, seen by BBC Sandesaya, by Gen Fonseka's spokesperson Mangala Samaraweera, MP, also said High Security Zones (HSZs) will be dismantled "in keeping with relocation of the security forces".

It said the programme was handed over to TNA parliamentary group leader R Sampanthan by Gen Fonseka after a meeting in Colombo.

While addressing the media last November to announce his decision to run for the presidency, unable to field a query from a journalist, a not-so-confident Fonseka admitted that he lacked sufficient political experience to give an exact answer; he claimed that he was not the only brain in the Opposition alliance and he could always count on other brains in tackling vital issues. Those brains around him have proved that they cannot even handle his propaganda without bungling. With such friends, he needs no enemies!

Fonseka may have been attractive to the public as a battle-hardened, plain-spoken and unwavering military officer capable of standing his ground and grasping the nettle but he has failed the first test of intestinal fortitude and sangfroid in politics. He has proved he is naïve, malleable, weak-kneed and lily-livered.

Meanwhile, the SL indictment is sure to aggravate the JVP's woes in that its trade union chief K. D. Lal Kantha has struck a discordant note over the war crimes issue; he has said, in public, that Fonseka is being branded as a traitor for allegedly having made war crimes charges against the army and if Fonseka has actually said what is being attributed to him, that description fits him! It will be interesting to know Lal Kantha's position on the SL expose.

A Mission Cyclops: Sarath F. the man who consumed by anger, resulting in Amnesia (Dimentia)

“Anger is a sort of madness and the noblest causes have been damaged by advocates effected with temporary lunacy...” - Mahatma Gandhi.

However, Gen. Fonseka seems to be consumed by anger, resulting in amnesia (dementia?), he comes out like a man driven by wrath and nothing else. The reasons (excuses) given in his letter of resignation from the post of Chief of Defense Staff (CDS), are actually not reasons for a person of his stature, to resign. It would have been better for him to resign without giving any reasons, especially those reasons, because then we would not have known his egoistic inclinations, which was the only note worthy information that came out from his letter of resignation.

He has based his political campaign on anger arising from these same so called injustices done to him. His main lamentation is the lack of “power” in the newly created position of the CDS
.


Sarath Fonseka himself is playing the Cyclops role pretty well even before it’s officially born by letting his anger and hatred get the better of him in the political stage and in the press interviews he is giving. He is betraying and slighting the very people he gloated about right after the war. A good example is the much publicized interview given to the Sunday Leader of 13th December 2009, in which he categorically alleges that Defense Secretary Gotabhaya Rajapaksha of giving orders to Maj. Gen. Shavindra Silva to shoot anybody who tries to cross over to the government side, even with ‘white flags’, during the last few days of the war. This statement was definitely given to the papers in a bid to win over the minority votes and with revenge in mind, however, it infuriated the Southern voter and most except a few in the South cried foul. SF didn’t think for a moment the damage he is doing to the country by making such grave statements. This statement is not only treacherous, but also the international implications could be overwhelming. He has put everything in second place, including the good name of our motherland, in a bid to gain power.

A constant in the SF campaign statements has been their inconsistency, Fonseka says and his minders try to unsay them, but by that time a sizeable damage has been done. The government has been quick to pick on his contradictory statements.

I am amazed at the hatred he carries around, and how quickly this hatred has turned a respected war hero into a mud slinging politician with no ethics. His whole campaign up to now has been devoid of substance or policy or a vision for the country. It has been based on elementary political promises like increasing the government servants’ salary by Rs.10,000.00 or giving an unemployment allowance of Rs.2000.00 to the unemployed graduates and so forth. Where is a strategy and a vision for the development, reconstruction and reconciliation of post-war Sri Lanka?

There is very little the voter can gather from his speeches, of his future design for Sri Lanka, hence, it can be said of his speeches that they are a collection of hurriedly gathered-up ad-hoc facts delivered amidst barrages of mud.

In transition: Steamy General Side up in public view -Who is this Wild Vulgar Army Officer?

There is an element of hesitation in writing the following few points that concern a top general of the Sri Lanka army since retired. Who he is and what he did to earn notoriety is something we leave to the readers to discern and appreciate.

There is no originality in this column. It was simply borrowed from a pamphlet that is making rounds for a while. Our contribution is limited to translating what was originally in Sinhala and bring it to the notice of a wider audience inside and outside the shores of our country.

The issues that are kicked up in the pamphlet and the questions that are brought upfront do sound vulgar here and there. What can we do? We are helpless. That is what is written in the original Sinhala and that is what is being circulated.

1. Who became the last of 16 participants of the 3rd Cadet Batch Course in 1970?

2. Who raped the domestic servant named Dhanawathie, then employed by Major General G P Kulatunge of the Sinha Regiment inside a room at the training camp in Diyathalawa and then got punished for the crime at that time and later was lucky enough to be the Head of the Army? Dhanawathie went mad later and the charge sheet can be produced.

3. Who is the only commander in any army in the world who got disqualified to receive the highest honour for the best conduct and discipline in the army?

4. Who is the senior officer with a history of homosexual relationships with poor barmen who served in the officers’ bungalows?

5. Who loves the company of lesbian army soldiers?

6. Who is the army officer who bites the breasts of women soldiers until they bleed while they are in bed with him?

7. Who is the army officer who frowns upon the junior men while fancying the women soldiers so much?

8. Who loves to inspect the hostels of women soldiers so much and then leave the personal mobile number on a notice board to contact him if they have any issue to be resolved – and then laying traps to get them to bed?

9. Who protected Captain Lakshmi Denagama, the woman with bad breath who used to rob innocent parents of soldiers while being in charge of the section of entering their children to schools? Who provided her with a luxury car, a driver and unlimited fuel something even very senior officers were denied of?

10. Who used to sleep with the two notorious women soldiers – Priyangani and Sakalasuriya – with an enviable reputation of a pair of whores who could even sleep with three wheel drivers and later promoted them in the rank while enjoying with both of them in bed at the same time?

General Fonseka’s allegation and its impact on the armed forces: A Legal Perspective

Let us take, hypothetically, the case of a member of the 58th Division traveling in the United Kingdom on official business, for medical treatment, in connection with the education of a child, on holiday or for any other purpose.

General Augusto Pinochet, in similar circumstances, was arrested in a London hospital a few minutes before midnight on October 16, 1998. The warrant of arrest was issued by a metropolitan magistrate in London pursuant to an order by the Fifth Central Magistrate of the National Court of Madrid in Spain .

The evidence against Pinochet was largely circumstantial. By contrast, members of our own Armed Forces are directly implicated by the statement of General Fonseka who was Commander of the Sri Lankan Army at the relevant time.

The nature and degree of the risk to which they are exposed are all too evident on the basis of emphatic statements of the governing law in the Pinochet case.

The final hearing was by the highest court in the United Kingdom – The House of Lords – in the presence of seven Law Lords.

Their exposition of the principles of public international law, which will clearly govern the liability of members of the 58th Division, will enable the public in our own country to assess for themselves the gravity of the situation.

In the Pinochet Ugarte case Lord Phillips of Worth Matravers, in the House of Lords observed: "There are some categories of crime of such gravity that they shock the consciousness of mankind and cannot be tolerated by the international community."

There can be no conceivable doubt that the cold blooded killing of persons attempting to surrender with white flags falls well within this category of crime.

Lord Phillips continued, and his comments are immediately relevant: "Any individual who commits such a crime offends against international law. The nature of these crimes is such that they are likely to involve the concerted conduct of many, and liable to involve the complicity of the officials of the State in which they occur, if not of the State itself. In these circumstances it is desirable that jurisdiction should exist to prosecute individuals for such conduct outside the territory in which such conduct occurs".

The firm entrenchment of this doctrine in public international law today is underscored in the judgement of Lord Goff of Chieveley: "It can no longer be doubted that, as a matter of general customary international law, a state official will personally be liable to be called to account if there is sufficient evidence that he authorized or perpetrated such serious international crimes."

Not only is the principle of personal penal liability one of the core values of the international legal system at the present day, but there is categorical recognition of the duty of all states to uphold and enforce this principle without compromise in any form. Lord Hutton, delivering judgement in the Pinochet case said: " There is a clear recognition by the international community that certain crimes are so grave and so inhuman that they constitute crimes against international law and that the international community is under a duty to bring to justice a person who commits such crimes."

The wide sweep of this imperative duty, and the tenacity with which countries are enjoined by international law to give effect to it, form the cornerstone of the judgement by Lord Nicholls of Birkenhead: ``The United Nations has put some of the necessary nuts and bolts into place for bringing persons suspected of having committed such offences to trial in the courts of individual states. States were to assist each other in bringing such persons to trial, asylum was not to be granted to such persons, and States were not to take any legislative or other measures which might be prejudicial to the international obligations assumed by them in regard to the arrest, extradition and punishment of such persons."

UNP loses another ‘big jumbo’ as Tilak joins Rajapaksa

The United National Party’s (UNP) former Treasurer and Bandaragama organizer Tilak Karunaratne came out in support of President Mahinda Rajapaksa’s candidature this evening (January 02) during a propaganda rally at Kalutara.

Mr. Karunaratne resigned from all posts he held in the UNP, including the post of Treasurer. Along with S.L. Gunasekera, Tilak Karunaratne was also a founder member of the Jathika Hela Urumaya (JHU) and was its General Secretary. He later quit the party.
